Moreno Valley Council District 4 Candidate Ulises Cabrera Warned By DA’s Office on Perjury

Moreno Valley Councilmanic District 4 Candidate Ulises Cabrera receives personal warning from Riverside Counties District Attorney’s Office in regards to Perjury, on Monday June 5th, 2017. 

Based on a complaint filed with the District attorney’s office for perjury against Ulises Cabrera in the filing of his California Form 700 (statement of economic interests) in which he omitted or failed to provide complete accurate and truthful statements in regards to his business dealings, ownerships and partnerships, in which he claimed he had none, when in fact he has several.

Mr. Cabrera in his desire to fulfill the dreams of Highland Fairview as well as those of Moreno Valley’s Mayor Yxstian Gutierrez and Mayor Pro-Tem Victoria Baca is now up to speed on California disclosure law with a warning of DON’T DO THIS AGAIN (Lie to the public).

Now for my message to Ulises Cabrera, I hope you realize what your actions have done to not only yourself but to members of you family and their businesses, this was only a minor issue at this point however more is to come in the weeks and months to come with yet several other criminal complaint files with various agencies within the State of California.

Background History

Approximately June of 2016 subject Ulises Cabrera (D.O.B. of March 24th, 1995) moved to the City of Moreno Valley, CA. from Austin, Texas (records indicate), and Texas Driver’s License No. of 342XXXXX, original issue of 12/14/2010.

Upon moving to Moreno Valley the subject took up residency within the City of Moreno Valley at 13792 Redlands Blvd., Moreno Valley, 92555 (with his father Martin Cabrera and his brother Martin Cabrera)on approximately June 26th, 2016 where he lived until February or March of 2017 at which point the subject moved within Moreno Valley to a residence of relatives (the family of Eduardo Pena) apparently in order to qualify for a run at Moreno Valley’s District 4 council seat, subject remains residing at the new location located at 16115 Rancho Del Lago, Moreno Valley, CA. 92551.

On specific dates during November of 2016, Ulises Cabrera created, started or became engaged in several businesses located with the City of Moreno Valley, those business are but are not limited to the following business entities; SpiritLift Organization, U=MC2 Construction, as well as The Website Whiz (further information attached as exhibits as per these three know entities).

On November 16th, 2016 Ulises Cabrera did file with the Riverside County’s Clerks a Fictitious Business Name for SpiritLift, which is registered under the number of R201614310, the registration is for one business under two (2) registrants, one of which is Ulises Cabrera, the other is unknown at this time.

Spirit Lift is an organization formed between Ulises Cabrera and his brother Martin Cabrera which is seeking tax exempt status (Per subject’s public statements). Spirit Lift is operated out of the City of Moreno Valley, CA. and is a form of mentoring program.

U=MC2 Construction is purported to a “father and son” business doing business under the private contractors license of Martin Cabrera (the father), license number 752824, originally issued on August 11th, 1998 and reissued on November 16th, 2016 and shows no association with U=MC2 Construction per the Contractors State Licensing Board (CSLB). U=MC2 Constructions shows an address of 13792 Redlands Blvd., Moreno Valley, CA. 92555, which is the same residential address of the license holder Martin Cabrera. Upon U=MC2 Construction’s website it shows the following contact information, Ulises Cabrera at (562) 786-9097 and Martin Cabrera at (310) 598-8450, the website itself is registered to Ulises Cabrera and was registered on November 25th, 2016 with an email contact address of ucabrera310@yahoo.com.

On March 8th, 2017 candidate for Moreno Valley’s Councilmanic District 4 Ulises Cabrera, did file with the city’s elections official (the Moreno Valley City Clerk) a California Form 700 (Statement of Economic Interest) signed under penalty of perjury.

The form is a required step in seeking candidacy to run for election as city council member in the City of Moreno Valley and was filed by Ulises Cabrera to run for elected office to be filled by special election on June 6th, 2017 to fill the vacancy left as a result of last Novembers election in which then District 4 Councilman Yxstian Gutierrez was elected to the office of Mayor of Moreno Valley.

Officials listed in Government Code Section 87200 (e.g., boards of supervisors, city council members, planning commissioners, elected state officials, etc.) must report investments, business positions, and sources of income, including receipt of gifts, loans, and travel payments, from sources located in or doing business in their agency’s jurisdiction.


Allegations

It is hereby alleged that Mr. Ulises Cabrera omitted from his filing of California Form 700 any and all information required in section 4 (Schedule Summary) as well as any schedules which would have been required, as it pertains to his businesses, partnerships and or other forms of income and that such omission was intentional. Such intentional omission is a violation of California Penal Code Section 118 and was done so upon subjects California Form 700 signed under “penalty of perjury”.

Mr. Cabrera has publically advertised his ownership and/or partnerships in local businesses and organizations, of which he derives income, these publications come in the form of his political campaign mailers sent out to the voting public, to video tapped speeches he has given during his campaign, prior to and after the filing of his Statement of Economic Interests, it is therefore further alleged the omission of said information from Ulises Cabrera’s California Form 700 was intentional.

It is also alleged that the subject Ulises Cabrera started said businesses in furtherance of his planned campaign run for the elected position for the now vacant seat in Councilmanic District 4 and that said businesses were created to bolster the subjects campaign, along with the false history narratives of residency within Moreno Valley created by the subject with the assistance of Moreno Valley Mayor Yxstian Gutierrez and Moreno Valley Council Member (Mayor Pro-Tem) Victoria Baca.

Withholding of such information on disclosure forms deprives the citizens of their right to control the government they have created as it removes the ability for the public to monitor not only its elected officials but also those seeking to be elected by withholding such material facts from the public. One does not need to make a false statement to commit an act of perjury, omissions as well as silence such as upon any one of the state’s disclosure forms filed “under penalty of perjury” would suffice.

Specific Requirements under California Government Codes:

Government Code Section 87201 clearly states: Every candidate for an office specified in Section 87200 other than a justice of an appellate court or the Supreme Court shall file no later than the final filing date of a declaration of candidacy, a statement disclosing his or her investments, his or her interests in real property, and any income received during the immediately preceding 12 months.

Government Code Section 87207 Sub Sec “b” states in part: If the filer’s pro rata share of income to a business entity, including income to a sole proprietorship, is required to be reported under this article, the statement shall contain:

(1) The name, address, and a general description of the business activity of the business entity.

Government Code Section 87209: When a statement is required to be filed under this article, every person specified in Section 87200 shall disclose any business positions held by that person. For purposes of this section, “business position” means any business entity in which the filer is a director, officer, partner, trustee, employee, or holds any position of management, if the business entity or any parent, subsidiary, or otherwise related business entity has an interest in real property in the jurisdiction, or does business or plans to do business in the jurisdiction or has done business in the jurisdiction at any time during the two years prior to the date the statement is required to be filed.

Ulises Cabrera is no newcomer to the world of politics and the seeking of elected office, as he ran in 2014 for an elected state office in Texas against George P. Bush for the office of Texas Land Commissioner and lost.

This article is applicable to elected state officers, judges and commissioners of courts of the judicial branch of government, members of the Public Utilities Commission, members of the State Energy Resources Conservation and Development Commission, members of the Fair Political Practices Commission, members of the California Coastal Commission, members of the High-Speed Rail Authority, members of planning commissions, members of the board of supervisors, district attorneys, county counsels, county treasurers, and chief administrative officers of counties, mayors, city managers, city attorneys, city treasurers, chief administrative officers and members of city councils of cities, and other public officials who manage public investments, and to candidates for any of these offices at any election.

GOVERNMENT CODE

Section 87201

87201. Every candidate for an office specified in Section 87200 other than a justice of an appellate court or the Supreme Court shall file no later than the final filing date of a declaration of candidacy, a statement disclosing his or her investments, his or her interests in real property, and any income received during the immediately preceding 12 months.

This statement shall not be required if the candidate has filed, within 60 days prior to the filing of his or her declaration of candidacy, a statement for the same jurisdiction pursuant to Section 87202 or 87203.

  1. Could not figure out why Cabrera looked familiar until I saw where he previously lived – my neighborhood. For almost a year they sold tacos out of their garage on weekends. Guess he does not understand that selling tacos from your home violates all kinds of regulations.

  2. It has made me nut trying to figure out why Cabrera looked so familiar to me. Now I realize he and his family where the occupants of the home at the end of my block (Stevens & Redlands Blvd) that sold tacos out of their garage on multiple weekend over the past year.

  3. I don’t know why the people in moreno valley have not seen a pattern by now with his candidates. People in this city need to get more involved and stop complaining about not having amenities and stop complaining about high taxes, less police etc…and stop using the excuse of im busy and WAKE UP! This has been going on way to long. They love to blame and point fingers and started to make it partisan race but fail to investigate these people running. We are in the new age of technology and they act like we live in the 1800. Word got around better in those days when people cared about the community. Now its I have no time..such a shame. Lets hope for the best tonight. If the outcome goes to Highland Fairview the citizens are only to blame for not participating. Many of our issues start at local gov.

    • Local government is where it needs to start, these are the politicians that will work their way up into higher levels of political power, if they are not taught a lesson and get away with whatever they want, and that’s what you will get when they seek higher office and more.

      Let it be known I vetted ALL D4 candidates (yes even Hector Diaz) if I would have found anything of real value on them I would have said so, as such I have said my piece on Mr. Diaz as for the other two real people in this race, CLEAN.

      When I say other two, that is because as I see it, this is a race between citizens and a corporation using a person as a pawn for their own agenda, so to me, Ulises Cabrera doesn’t count as a real candidate as corporations cannot seek elected office.
